Confidentiality Agreement
All Users data held on DIDIDave.com from Usernames, Passwords, Email address and any IPs held on the database or transmited via the peerlist are deemed confidential information and for the sole use of DIDIDave.com.
The Use of this information for anything other then use on site will be deemed to be a disclosure of confidential information.
In using this information other then on site you have broken the DIDIDave.com Confidentiality Agreement and may allow damages claims in the event of wrongful use or disclosure of confidential information other then that as specified by the DIDIDave.com site.
If any information gained from DIDIDave.com is used in what DIDIDave.com or its user base deem as breaking this Agreement and/or a user suffers as a result in the use of this confidential information the said user will be given the user datails as to who has leaked there confidential information so as to make a claim against them.
This Confidentiality Agreement ("Agreement") is made and effective On the users signup date by the user and between DIDIDave.com. 1. Confidential Information.
DIDIDave.com proposes to disclose certain confidential and proprietary information ("user IP addresss, Release data, Torrent Name, Dates/Times, Emails, User Names,Or any other information gained Via access to DIDIDave.com") to the Recipient. Confidential Information shall include all IP data on a torrents peer list, to the Recipient by DIDIDave.coms Tracker Peer List. Confidential Information disclosed and identified as such is for the Recipients own personal use on Dididave.com only. 2. Recipients Obligations.
A. Recipient agrees that the Confidential Information is to be considered confidential and proprietary to DIDIDave.com and the Recipient shall hold the same in confidence, shall not use the Confidential Information other than for the purposes of its business with DIDIDAVE.com. Recipient will not disclose, publish or otherwise reveal any of the Confidential Information received from DIDIDave.com to any other party whatsoever except with the specific prior written authorization of DIDIDave.com.
B. Confidential Information furnished in tangible form shall not be duplicated by the Recipient except for purposes of this Agreement. Upon the request of DIDIDave.com, Recipient shall return all Confidential Information received in written or tangible form, including copies, or reproductions or other media containing such Confidential Information, within ten (10) days of such a request. At Recipients option, any documents or other media developed by the Recipient containing Confidential Information may be destroyed by Recipient. Recipient shall provide a written certificate to DIDIDave.com regarding destruction within ten (10) days thereafter. 3. Term.
The obligations of Recipient herein shall be effective from the Recipients join up date or use of a .torrent all information is given. Any Confidential Information to Recipient pursuant to this Agreement. Further, the obligation not to disclose shall not be affected by bankruptcy, receivership, assignment, attachment or seizure procedures, whether initiated by or against Recipient, nor by the rejection of any agreement between DIDIDave.com and Recipient, by a trustee of Recipient in bankruptcy, or by the Recipient as a debtor-in-possession or the equivalent of any of the foregoing under local law. 4. Governing Law and Equitable Relief.
This Agreement shall be governed and construed in accordance with the laws of DIDIDave.com choice and the laws in the country or orgin of the Recipient and the Recipient consents to the exclusive jurisdiction of any court as set by DIDIDave.com for any dispute arising out of this Agreement. Recipient agrees that in the event of any breach or threatened breach by Recipient, DIDIDave.com may obtain, in addition to any other legal remedies which may be available, such equitable relief as may be necessary to protect DIDIDave.com or its users against any such breach or threatened breach. 5. Final Agreement.
This Agreement terminates and supersedes all prior understandings or agreements on the subject matter hereof. This Agreement may be modified only by a further writing that is duly executed by both parties. 6. No Assignment.
Recipient may not assign this Agreement or any interest herein without DIDIDave.coms express prior written consent. 7. Severability.
If any term of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, then this Agreement, including all of the remaining terms, will remain in full force and effect as if such invalid or unenforceable term had never been included. 8. Notices.
Any notice required by this Agreement or given in connection with it, shall be in writing by on site PMs. 9. No Implied Waiver.
Either partys failure to insist in any one or more instances upon strict performance by the other party of any of the terms of this Agreement shall not be construed as a waiver of any continuing or subsequent failure to perform or delay in performance of any term hereof. 10. Headings.
Headings used in this Agreement are provided for convenience only and shall not be used to construe meaning or intent.
IN WITNESS WHEREOF, the parties have executed this Agreement as of the date first joining and accepting the agreement to enter the signup page or by the fact of running any DIDIDave.com .torrent file which has been uploaded to a 3rd party site without DIDIDave.coms consent with due warning to the Recipient of the above Agreement being in effect if used.
IP Tagging Of Users
The IPs of users of DDT are considered Private and anyone found to be Tagging Users IPs via the swarms peerlist will be banned from the site when found.
Data protection Act:
If you wish to use IP addresses to identify or build a profile of a user or individual, you should assume that the Data Protection Act applies. Only a court can decide for certain whether or not this is a processing of personal data to which the Act applies. The safest course is to assume that the Act does apply in these circumstances and therefore you should make users and staff aware of your intentions to use IP addresses to gain further information on the sites userbase ,based on there IP used here and also gain consent before processing an IP address tagged from the DDT Peer list for these purposes.
If you wish to tag users IPs via a swarms peer list Please contact staff as to your actions and intensions before doing so.
If you fail to inform the Users / Staff of your actions to mine the DDT site for Users IPs Then further action can and will be taken to protect this data.
Why Are Free Emails Banned From This Site
simple answer to that is when your banned from here for bearking rules or what ever caused a user to get banned they should stay banned.
Banning Free email providers aids in this as they will find it harder to get a new account.
Once you have signed up with DDT you can change email addresses at will to any provider you wish free or not we dont mind at this point once your on site.
We dont just block known free providers we also block other domans we would rather not have users from.
If you try to use a free provider on signup not found in the ban list does not mean it right and you may well find that the account once created will be banned as all users emails are checked and if found to be a none banned provider of free emails they are added to ban list and the account created will be banned.
If you cant follow the first rule on signup then that user does not warrant an account here on DDT...

Do not defy the moderators expressed wishes!
If you have no intention of downloading a torrent,there is no need to comment on it,especially flaming.One persons bad quality is anothers satifactory.
If you have been warned by a mod it is very unlikely and admin or sys-op will overrule the decision.If you feel you have been harshly treated,contact the mod that warned you first.
Only 1 account per IP,dupe accs will be disabled and the first acc warned.If you require a 2nd acc PM a member of staff first.
Use your invites wisely,any acc abused by a member,then the invitee may be held responsible aswell.
Cheating you ratio is totally unacceptable,our anti-cheat script will pick you up,and ALL your upload total will be removed.you have been warned!
Only VIPS may make requests,any user requesting files in shoutbox/irc/pm will be warned and rights removed if done again
Email Accounts On Signup
All free email account are banned from signup.A full list is provided on the signup page and if in doubt please read the list to insure it is not in there.
If you fail to do this and you try to use a free email account the account will not be created.
When signing up to DDT you will be given 2 chances only to get a working account.If you fail to provide a working non free email address 2 times your IP is banned for 24 hours.
Once you have your account set up your welcome to change it to any free provider you wish.Its only while signing up that free providers are banned and is so its harder for banned users to obtain accounts using many different email providers.
Proxy Servers
DDT has a number of scripts on-site and also on the signup section to prevent the use of free proxy servers and TOR servers.
Even though you may get in using one at the time of signing up the proxy server list is updated all day and night and new IPs added.
Any user account found to be using a proxy server IP will have there account closed with out warning.
Account Usage
All user accounts must be used at least once a month.Failing to do so will mean the tracker deletes your account with 7 days warning before it deletes the account.
If after these 7 days there is still no download made on the account the tracker deletes it as a LURKER... LURKER = User here for other reasons other then site is meant for.
Example:- Copyright inforcment...Here to log what is and what not added to site and gain information from peer list as to what users are doing and what IP they use. Trouble MakersHere to cause trouble for staff and users.Posting spamming ect ect Invite TradersUsers who create accounts in the hope that a site becomes invite only so thay can then trade invites to other sites or worse still sell them via other means. Every torrent downloaded should be seeded back 1:1,or to near as is possible while there are active downloaders
Hit and running torrents will not be tolerated,warnings will be issued for this automaticaly by the H&R script.To have the warning removed,reseed the torrent and when seeded 1:1 or as close to it as possable while there are active users downloading the warning is automaticaly removed.
Accounts with multiple hit and runs (6th H&R) will have their download privelage removed.Again to resolve this reseed those torrents with a H&R warning.
An acc with a low ratio would on other sites have there downloads removed or massive wait times imposed.Here you will not as long as you seed what you download to your highest possable ratio as close to 1:1 as is possable at all times.
You must have the legal rights to the files you download.

H&R PM Request ? What does it mean ?
Stop Torrent (Ratio Less Then 1:1)
After a maxium of 1 hour after stopping the torrent you will get a PM asking you to reseed.
THIS IS NOT A WARNING !!!!!
What to do now you had a PM Request ?
In the PM there will be some information as to your upload/download and how many downloaders still active on that torrent.
You need to decide if your going to reseed or if there is any need to reseed the torrent in question.
If there are no active downloaders DONT NEED TO RESEED IT
If there are active downloaders or if you know/think there will be in the next 3 hours then you will need to reseed the torrent if you do not wish to get a warning
You re-seed the torrent (1:1 ratio reached)
If you re-seed the torrent as requested an d to a 1:1 ratio no warning will be given
You re-seed the torrent (1:1 ratio NOT reached)
If you re-seed as requested but then find that there are no active downloaders left to seed it to then your able to stop seeding it.
As long as you seeded untill there are no active downloaders no matter what the ratio NO WARNING WILL BE GIVEN
You FAIL to re-seed when requested
If you fail to reseed the torrent when asked and there are active downloaders you are what is called a Hit and Runner (Leecher)
One H&R warning will be put onto you account
To remove this warning its a simple matter of reseeding the torrent even after the warning is given IT WILL THEN BE REMOVED
You H&R more then once ?
If you H&R more then 5 times you will lose you downloads
If you have your downloads removed this way you will need to
Reseed any torrents that have a H&R warning
Wait a mxium of 14 days untill tracker removes 2 warnings from everybodys account
Donate to remove the warnings and also have a period of time where the script will let you H&R
Asking staff to remove the warnings will not work as only the tracker can remove them. Telling us that your system has a problem will not help !! Its your system your own issue to sort NOT THAT OF STAFF !!! Repeated Requests of this nature will insure your account is banned for a longer time.

Be considerate.
Resize your images to a width of 150 px and a size of no more than 150 KB. (Browsers will rescale them anyway: smaller images will be expanded and will not look good; larger images will just waste bandwidth and CPU cycles.)
For now this is just a guideline but it will be automatically enforced in the near future.
Do not use potentially offensive material involving porn, religious material, animal / human cruelty or ideologically charged images. Mods have wide discretion on what is acceptable. If in doubt PM one.

You are connectable
You must have legal rights to the file you are uploading.
It is essential to be responsible with your bandwidth.If you have an average upload speed of 256kb/s(30kB/s),you are best to only upload one file at a time,regardless of size,until it has at least a couple of seeds.
It is not a requirement to upload files here,but if you do,we ask you not to use your bandwidth elsewhere when uploading a torrent,this is to ensure your full upload speed can be committed to the torrent you have uploaded.
Bear in mind that a large file,such as a dvd/r can take up to 48hrs to seed propperly,this is a big commitment,and you must be willing to accept this if you upload.
Any torrent without a seed,and on tracker longer than an hour will be deleted by staff,1 unseeded torrents and your right to upload will be removed until you can convincea mod it was for a genuine reason.
Any torrents found by staff with ridiculous upload speed will also be deleted,and again,your right to upload removed.
All uploads must include a detailed description.

All files must be in a legitiment format so they are functional.
Pre-release stuff should be labeled with an *ALPHA* or *BETA* tag.
Make sure not to include any serial numbers, CD keys or similar in the description (you do not need to edit the NFO!).
Make sure your torrents are well-seeded for at least 24 hours after you have uploaded to new seeds.
Do not include the release date in the torrent name.
Make sure you torrent goes in the right group,if you dont know what a scene release is,then it goes in the user section
Make sure you remove other site urls from torrent names and NFOs if you have downloaded from else where,We are not here to advertize other sites and any torrents found to have links torrent names to other sites will be deleted with out warning and uploads removed from your account
